Terms and Conditions

Definitions:

For the purposes of these Terms and Conditions, the following definitions apply:

• "Website" as used herein refers to the OurChurchPrays.com Website located at http://OurChurchPrays.com.
• "You", "Your" and "User" as used herein refer to all individuals and/or entities accessing this Website for any reason.
• "Ministry" as used herein refers to Christian prayer ministry e-mail groups that use OurChurchPrays.com for communication.
• "Service" as used herein refers to email communications and web site operations at OurChurchPrays.com.
• "We", "Staff" as used herein refers to the staff and owners of OurChurchPrays.
• "Administrators" as used herein refers to the individual administrators of each prayer ministry.

Posted Material

Posted material includes and all information included in a prayer request. Submission of X rated, adult themed, gambling, hate, profanity, or prejudiced material or links is not accepted. Material posted on this site must be consistent with the Christian theme of the site. Advertising is strictly prohibited. Final judgment of the nature of material which may be perceived as inappropriate rests with the founders and administrators of this site.

This means that You, not the Staff and Administrators, are entirely responsible for all content that You upload, post, e-mail or otherwise transmit using the Service. The Staff, and Administrators do not control the content posted using the Service and as such does not guarantee the accuracy, integrity or quality of such content. Under no circumstances will the Staff, and Administrators be liable in any way for any content, including, but not limited to, unauthorized release of confidential information, erroneousness or incomplete information. Likewise, the Staff and Administrators will not be liable for any loss or damage of any kind incurred as a result of the use or public release of any content uploaded, posted, e-mailed or otherwise transmitted or hosted using the Service.

You acknowledge that the Staff, and Administrators do not pre-screen content, but that the Staff and Administrators of the Website shall have the right (but not the obligation) to refuse, or delete any content that is made available using the Service. You agree that You will evaluate, and assume all risks and obligations associated with the use of, any content, including reliance on the accuracy, completeness or usefulness of such content.

You also acknowledge and agree that the Staff, and Administrators may remove content at any time. Furthermore, You agree that the Staff and Administrators may disclose content, including information about Your account or Your use of the Service, to any third-party if required to do so by law or in the good faith belief that such disclosure is necessary to:

• Comply with legal process;
• Enforce these Terms and Conditions;
• Respond to claims that any Content violated the proprietary rights of third parties; or
• Protect the rights, property, or personal safety of the Staff, Administrators, Members or the public.

Security

Any attempt to use the this Website or any associated services for any use other than their intended use may result in cancellation or Your membership. Any attempt to violate security on this Website will result in Your banishment from this Website, and cancellation of Your account.

Services

The Service on this site is to be used at Your own risk. Although the Staff's best effort will be made, this Website makes no guarantee of any kind about the timeliness, dependability, safety, proper operations, or availability of the Services provided. The Service is provided on an "as is" and "as available" basis. The Staff will make every effort to correct any problems of the Website. This Website may stop its service at any time. It is the intention of the staff to maintain an uptime of in excess of 99.5%. However, the Staff cannot be held liable for failing to meet this level of service in excess of $.15 per day.

Damages

This Website, its staff, or Administrators cannot be held liable for any damages that may occur either directly or indirectly due to the Services on this Website. You agree to defend, indemnify, and hold this Website, its Staff, and Administrators harmless from and against any and all claims, losses, liability costs, and expenses (including but not limited to attorney's fees) arising from the use of the Services of the Website, Your violation of this agreement, or any third party's rights, including but not limited to infringement of any copyright, violation of any proprietary right, and invasion of any privacy rights. This obligation will survive any termination of this agreement. Because some states or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the limitations set forth in the immediately preceding provisions may not apply to You. If the limitations set forth above are held to be inapplicable or unenforceable for any reason, then OurChurchPrays' maximum liability to You for any type of damages shall be limited to U.S. $100.00.

Account Cancellation

Failure of members of a Ministry to abide by the Terms of Service can result in the Ministry's removal from the site. One attempt will be made to notify the Administrator of the Ministry and seven days will be allowed to correct the situation prior to cancellation. Any refunds provided in this event will be provided at the sole discretion of the Staff.

Terms Modification

We reserve the right to change these terms at any time. You will be notified by email if a change has occurred. You should visit this page to review the Terms and Conditions before using the Website.
